2. DELIVERY AREAS

BESHAP delivers to the countries and territories offered to the customer at checkout.

The availability of a destination may change depending on:

  • available carriers;

  • logistical constraints;

  • local restrictions;

  • customs conditions;

  • the availability of delivery services.

A destination is considered available when it can be selected at checkout.

3. DELIVERY ADDRESS

The customer is responsible for the accuracy of the information provided when placing the order.

In particular, they must check:

  • their first and last name;

  • the street number and name;

  • any additional address information;

  • the postal code;

  • the city;

  • the country;

  • their telephone number;

  • their email address.

BESHAP recommends that the customer carefully check this information before validating the order.

Once the order has been sent to the logistics department or carrier, a change to the delivery address cannot be guaranteed.

4. ORDER PREPARATION

Once payment has been validated, the order is sent to the logistics center responsible for preparing it.

The preparation time may vary in particular depending on:

  • the date and time of the order;

  • weekends;

  • public holidays;

  • periods of high activity;

  • promotional operations;

  • product availability;

  • exceptional logistical events.

The delivery time communicated to the customer at checkout takes into account the information available at the time of purchase.

5. DELIVERY TIMES

The delivery times displayed at checkout constitute the applicable information for the relevant order.

When the delivery times below are announced on the website, they correspond to the times generally observed.

Metropolitan France

9. CARRIERS

10. ORDER TRACKING

11. DELIVERY DELAY

When the conditions provided for by law are met, the consumer may, in particular, request delivery within a reasonable additional period.

If delivery does not take place under the conditions provided for by the regulations, the consumer may exercise the remedies legally available to them.

12. NON-DELIVERY

When an order has not been delivered within the applicable timeframe, the customer must contact customer service so that a check can be carried out.

BESHAP may, in particular:

  • consult the carrier’s information;

  • open an investigation;

  • request additional information;

  • propose the appropriate solution based on the outcome of the investigation and the applicable legal obligations.

This internal procedure does not limit the consumer’s legal rights.

13. PARCEL MARKED AS DELIVERED BUT NOT RECEIVED

When tracking indicates that the parcel has been delivered but the customer states that they did not receive it, they are advised to check in particular:

  • their mailbox;

  • common areas;

  • their building caretaker or concierge;

  • household members;

  • neighbors;

  • any drop-off points indicated by the carrier.

The customer must then promptly contact:

BESHAP may open an investigation with the carrier.

The fact that tracking indicates “delivered” does not remove the consumer's legal rights regarding the actual delivery of the goods.

14. DAMAGED PARCEL

When a parcel arrives visibly damaged, the customer is advised, where possible, to:

  • photograph the parcel before opening it;

  • keep the packaging;

  • keep the shipping label;

  • photograph the damaged products;

  • report the issue promptly to customer service.

The customer is advised to keep the items concerned until the matter is resolved.

15. DAMAGED OR NON-CONFORMING PRODUCT

If the parcel is intact but a product is:

  • damaged;

  • defective;

  • different from the one ordered;

  • a different size from the one ordered;

  • or missing,

the customer must contact customer service.

These situations may be covered by legal guarantees and are not treated as a simple change of mind.

The consumer's legal guarantees remain applicable.

16. INCORRECT ADDRESS PROVIDED BY THE CUSTOMER

The customer must provide an accurate and complete address.

When a delivery failure results directly from an incorrect or incomplete address provided by the customer, BESHAP will assess the situation on a case-by-case basis.

A new shipment may incur additional fees when these are genuinely justified and when charging them is legally applicable.

No arbitrary fees will be applied.

17. UNCLAIMED PARCEL

When a parcel is made available at a pickup point or another delivery location and is not collected within the period specified by the carrier, it may be returned to the sender.

BESHAP will then assess the situation based on:

  • the reason for the return;

  • the costs actually incurred;

  • the consumer's legal rights;

  • the customer's request.

18. REFUSAL OF THE PARCEL

Refusing a parcel upon delivery does not necessarily, by itself, constitute a clear declaration of exercising the right of withdrawal.

When the customer wishes to exercise their right of withdrawal, they must use the procedure provided in the Returns, exchanges and withdrawal policy.

19. RETURN TO SENDER

When a parcel is returned to BESHAP or its logistics center, particularly for:

  • incorrect address;

  • unclaimed parcel;

  • refusal of delivery;

  • inability to deliver,

customer service reviews the case before determining the applicable solution.

Depending on the circumstances, a new shipment, an exchange or a legal refund may be offered or required.

20. INTERNATIONAL DELIVERIES AND CUSTOMS FORMALITIES

For certain destinations outside the European Union or in territories subject to special regimes, customs formalities may apply.

When taxes, customs duties or local charges are not included in the price paid to BESHAP, they may be claimed by local authorities or operators.

When BESHAP offers delivery including certain taxes or formalities, this information is provided to the customer before the order.

BESHAP does not charge the customer duties or taxes that are already expressly included in the price or selected delivery method.

21. POSSIBLE ADDITIONAL CHARGES

No additional delivery-related charges will be invoiced to the customer without a contractual or legal basis.

When additional charges may apply, they are communicated to the customer when known before the order is confirmed.

22. FORCE MAJEURE AND EXCEPTIONAL EVENTS

Certain events may exceptionally affect preparation or delivery, including:

  • natural disasters;

  • major weather events;

  • conflicts;

  • transport blockages;

  • administrative decisions;

  • major disruptions to transport networks;

  • other events meeting the legal conditions for force majeure.

This provision does not deprive the consumer of the mandatory rights provided for by applicable regulations.

23. WITHDRAWAL AND DELIVERY

The rules relating to delivery are distinct from the right of withdrawal.

When a consumer validly exercises their right of withdrawal, the consequences concerning in particular:

  • return of the product;

  • return costs;

  • reimbursement of the price;

  • any reimbursement of standard delivery costs,
